Carlson Caspers successfully enforced patents on behalf of CSI (an Emerson Electric Co. subsidiary) relating to machinery health maintenance vibration data analyzers incorporating sigma-delta analog-to-digital converters.  In response to the patent infringement litigation, the defendants challenged the validity of the patents by requesting reexamination with the patent office, hoping to avoid the “clear and convincing” burden of proof they faced in the litigation.  But our team successfully navigated multiple patents through the reexamination proceedings, maintaining our client’s claim for past damages while simultaneously strengthening its patent rights.  With this reexamination success, Carlson Caspers soon had a settlement license agreement in hand and a very happy client.
